Information for Faculty in Preparation for an Academic Misconduct Appeal

Once a student has initiated an appeal, you will be forwarded a copy of their letter to the Dean including their submitted evidence. You will be asked to respond to the student’s letter and to supply any evidence you used to determine the charge of academic misconduct.

Your response should be in the form of a letter addressed to either the Dean or the Chair of the Faculty Appeals Committee.

All of this information will then be organized into a package and supplied to all relevant parties including the Faculty Appeals Panel in preparation for the hearing.

The hearing has a very set process which must be adhered to. This process is outlined below:

Order of Hearing

  • The Hearing Panel Chair introduces the proceedings and all of the persons at the table.

  • These will be the Panel members, the person who charged the student with academic misconduct and any witnesses, the student and his or her advocate, if any.

  • Witnesses must remain outside the Hearing room until they are called upon to make their statements.

  • The person who charged the student with academic misconduct is asked to present the evidence used for making the charge. (You must come prepared to make a short oral presentation highlighting the decision you made, and what information you used to support that decision).

  • Any witnesses for the person making the charge are called and are asked to make statements.

  • The student is given the opportunity to ask questions for clarification of the statements presented by the person making the charge and his or her witnesses, if any.

  • Witnesses who wish to leave the Hearing as soon as is possible may be questioned by the Panel before they leave.

  • The student is asked to briefly present a summary of his/her case.

  • Any witnesses for the student are called and asked to make their statements.

  • The person who made the charge of academic misconduct is given the opportunity to ask questions for clarification of the statements presented by the student and his/her witnesses.

  • Members of the Hearing Panel ask questions of all parties.

  • The student is asked to present a final summary of his/her case.

  • The person who charged the student is asked to present a final summary of his/her case. (This is also your opportunity to address any statements that the student has made in his/her summary that you disagree with or that you would like to state your opinion. You can jot these thoughts down during the hearing so that you are reminded to say them in your closing. The instructor is given the last word so that you have the opportunity to confirm your decision and why).

  • Everyone who is not a member of the Hearing Panel is asked to leave before the Panel begins to deliberate.

The Panel Chair has the right to limit statements, especially if material is repetitive.  The Chair has the right to stop the testimony of witnesses if they are all testifying to the same point (e.g., the student was sick on the date in question).

The Panel Chair may declare any question to be out-of-order, if it is felt that it is not appropriate for the matter at hand.

The Panel Chair may adjourn the Panel, or may request a brief recess, for the discussion of any matter which the Panel should consider in camera.

The Panel Chair may request procedural or factual advice from the Academic Integrity Officer (AIO) during or after the Hearing.

The Panel Chair may make a ruling on any matter regarding the conduct of the Hearing.
