BICYCLE ROOM PARTICIPANT AGREEMENT
WHEREAS “Bicycle Room” is a component of the University’s bicycle initiative focusing on bicycle commuting and other environmental targets.
NOW THIS AGREEMENT WITNESSETH that in consideration of the covenants and promises set out hereunder, the parties have agreed that the governing terms and conditions shall be as follows:
USER
Students, staff or faculty of the University who commute regularly by bicycle will be eligible to enter into this agreement.
If the demand exceeds the capacity of the Bicycle Room, a waiting list will be maintained; bicycle space will be assigned on a first-come-first-served basis.
BICYCLE ROOM ACCESS
User access to the bicycle room will be in accordance with the Bicycle Room Access Procedure, which may be amended by Ryerson University from time to time.
USER DUTIES
The User will agree to use the room for the purposes of storing a bicycle only. No food, perishable items, hazardous or combustible materials including oils and aerosol cans, or any other personal property will be stored in the bicycle room at any time.
Users will not affix any additional locking devices, posters, decals, or any other materials or markings to the inside or outside of the bicycle room.
Users will not allow unknown or unauthorized people in the room.
At the end of the user period, the User will remove their bicycle.
It is a responsibility of the User to notify the University immediately of any difficulty accessing the bicycle room or of any damage to the bicycle room.
INSPECTIONS
The bicycle room will be subject to periodic inspections at the sole discretion of the University to confirm proper usage, assess maintenance requirements, or in the event of an emergency or reasonable suspicion that a health or safety concern exists.
LIABILITY
The University will not be responsible for the damage to, theft, or loss of any property stored in the room during the user contract. The University will not be liable to the User or anyone else for any damages whatsoever, including any indirect, special, incidental or consequential damages arising out of or in connection with the use of the bicycle room.
The User will be responsible for any damage caused by the User to the room or accessing mechanism during the user fee contract period.
INDEMNITY
The User agrees to defend, indemnify, and hold Ryerson University, its officials, employees, agents, and representatives harmless from and against any and all claims, losses, damages and expenses of any kind, including legal fees, which may arise as a result of the operation of the Bicycle Room and all related activities, or Ryerson University operations thereof.
TERMINATION
At the sole discretion of the University, this Agreement may be terminated by Ryerson University at any time with justifiable cause including an emergency.
