This course will examine the idea of Indigenous "criminality" in Canada through critical Indigenous theories, histories, and frameworks of settler colonialism. Foregrounding inherent Indigenous jurisdiction as the starting point for understanding Indigenous encounters with the criminal justice system in Canada, students will have an opportunity to learn about the politics of criminal law from the perspective of contested sovereignty. We will examine encounters between settler and Indigenous law (at blockades, through family law, on the streets) as well as the breakdown of legal pluralism.
